Peculiarities of goods release before the presentation of customs declaration
Before July, 1, 2018 the application for goods release before the presentation of customs declaration was put in in the paper form.
The statement form and the procedure of its completion are determined by the Resolution № 171 of Eurasian Economic Commission Board issued on December, 13, 2017.
According to paragraph 4 of article 120 of the CCEEU the application for goods release before the presentation of customs declaration must be accompanied by the following documents:
- documents that confirm conditions compliance and as provided by paragraph 13 of article 120 of the CCEEU customs authority performs goods release before the presentation of customs declaration;
- commercial or other documents that contain information about the consignor and the consignee, country of departure and country of destination, the goods (name, trademark, place of origin that are objects of intellectual property rights included in the integrated customs register of the objects of intellectual property rights of the Eurasian Economic Union or national integrated customs registers, description, customs code in accordance with goods nomenclature at no less than the first six digits, quantity, gross weight and value). In case the above mentioned documents lack the necessary information such information is filled in the application for goods release before the presentation of customs declaration.
Thus, in case the goods release is performed based on the standards of article 120 of CCEEU customs authority conducts the control of prohibitions and restrictions and assumes the measures on intellectual property rights protection at a point of goods release before the presentation of customs declaration.
At the same time at present the information systems applied by customs authorities don’t allow the conduct of automatic control of prohibitions and restrictions and the measures on intellectual property rights protection. Customs officials have to carry out these types of control in manual form. This approach leads to the growth of goods release terms.
Taking into consideration the above mentioned information for the sake of electronic customs clearance development, reduction of goods release terms and automatization of information control declared in customs declarations Minsk regional customs recommend if possible to perform customs clearance of goods with the use of customs declaration the form of which is determined by the Resolution № 257 of Customs Union Commission issued on May, 20, 2010.
